minutes of the SEPTEMBER MEETING
OF members OF
Val Verde homeowners association

The undersigned, being all of the Directors and Officers of the Val Verde Homeowners Association, a Nebraska nonprofit corporation ("Corporation") hereby approve the following minutes September 19th, 2005 monthly meeting of the Members.

The meeting was called to order by Mary Hewitt at 7:00 pm at Portal Elementary School. Directors and officers present and participating were Mary Hewitt and John Eylander.  Jeremy Kinsey was on a business trip out of state.  Approximately 80 homeowner members were present. One invited guest, Ms. Cara Pavlicek, was in attendance.

1.             Approval of July Minutes:  The reading of the July meeting minutes was waived.  Hewitt announced meeting minutes, By-Laws, and Covenants are posted on the Val Verde HOA website.  Members are reminded the site address as WWW.ValVerdeHOA.COM . 

 

2.             Old Business: 

a.  Waived full review of accounts until next meeting to give all three board members and residents additional time to review them

b. Newsletters have been passed out to most streets.  If you would like a newsletter, please contact your street representative.

 

3.             SID report:

Eylander reported the street repairs would begin shortly.  Several sections of concrete will be replaced on many roads, and street cracks will be sealed.  The remaining street signs will also be posted.

 

Eylander stated that the final park plan was presented to the SID, and a notice to obtain bids was approved at the September 7 meeting.  There should be another SID meeting in October to choose the contractor from submitted bids.  After the contractor is chosen, the park will take about 40 days to complete.  Construction could be complete before the end of the year.

 

4.             President’s Report: 

Hewitt reported the next HOA members meeting would be Monday, October 24th.  Hewitt also stated that the Holloween parade would occur October 30.  More information about the Holloween parade will be available at the next meeting.

Hewitt announced the need for volunteers to assist with fall landscape planting.  The Landscape Committee will be purchasing spring bulbs, additional mulch, and a few plants to finish up the landscaping along the Val Verde Dr. median locations and the round-a-bout.  An announcement will be sent out via email soon.

 

 

 

5.             Invited Guest Presentation

Cara Pavlicek, City of La Vista Administrator, was invited to present information and answer questions pertaining to the upcoming annexation of Val Verde by La Vista.  Ms. Pavlicek has served as La Vista City Administrator for the past 8 ½ years.

 

Pavlicek gave a brief outline of the SID process.  The SID is a political subdivision of the state of Nebraska.  Boyer-Young Development bought the land to create the subdivision, and declared it an SID.  The developers received approval by city council to develop the subdivision.  Property taxes paid by property owners in the SID are used to pay down the debt of the SID.  The taxes are also used for subdivision maintenance, including street repairs, street lights, attorney fees, etc.

 

Pavlicek stated the city has budgeted and intends to annex Val Verde and Southwind this fiscal year beginning October 1.  The public hearing process will most likely begin in January, and the entire process will take roughly 90 days to complete.   After annexation, the city will take control of SID bank accounts and the SID will cease to exist as a political subdivision.  Property taxes will drop in 2007.  The SID levy of $.85 per $100 assessed value will fall to whatever the current city rate is.  The fire district levy currently used to pay for rural Papillion fire service would disappear since Val Verde would begin to be serviced by La Vista emergency services.

 

Pavlicek stated it could take up to 1 year for some services to transfer to the city, including 911 service while other services will begin immediately after annexation. La Vista police and fire service should begin within 60-90 days of annexation.  Residents will immediately be able to use the city library and city community center.  The city will begin to provide snow removal service upon annexation.   Garbage service will not change as long as current provider is licensed by the state.  The City of La Vista does not provide trash pickup.

8.                       The following statements are answers Ms. Pavlicek gave in response to questions asked by numerous residents during the open discussion period.

9.                        

·   Property valuations do not change with annexation. 

·   Water service will continue to be with MUD with no service change.  Sewer service will change to the city of La Vista.

·   The City last annexed property in 1999.

·   The park will need to be completed prior to annexation due to problems in the political issues.

·   One member asked why Val Vista had already been annexed.  Pavlicek stated the City had annexed the land Val Vista was developed on in 1999; therefore, the land owner who platted and developed the subdivision did so as a City Improvement District (CID) after annexation had already occurred.  Val Vista was never a SID.

·   The zoning jurisdiction for La Vista beginning at the northern border of the city is the Douglas/Sarpy county line; eastern boundary is roughly 66th street (Big Papio creek); southern boundary Giles Road from 84th to 96th Street, Cornhusker road west of 96th to Giles Road, Giles to 108th, and Cornhusker again out to highway 50 (144th Street).  The western boundary of La Vista is Highway 50 (144th Street).

·   Annexation of Val Verde will not affect a homestead exemption for those who qualify.

·   The City public works staff will pick up maintenance of the Centennial Park and pathway, including tree maintenance, grass mowing, and restroom facility maintenance.  City recreation staff will be responsible for scheduling shelters at the park.

·   The second La Vista fire station will be built at 108th and Chandler.  The City has approved the construction plan for 2nd fire station and should approve the authorization to bid the contract for construction on November 1st.  The city expects construction of the new station to take 1 year.

·   The fiscal year for the City begins October 1 and runs through September 30. 

·   The 96th Street widening project is still in the works.  The county had environmental issues to overcome at creek.  They are in the process of finalizing property acquisition.    Construction may begin south near highway 370 and move north.

·   Annexation of Val Verde has no effects on the covenants associated with property in the subdivision.  Covenants are an agreement with buyer/seller on the land.

·   Commercial abuts residential (problems with One Val Verde Place).  City won’t allow SID to construct fence.  May mediate between developer/One Val Verde Place/residents.

·   Boyer-Young will be building west of Val Verde…no commercial no multi-family…all single residential.  Developer needs more changes modified.  Tabled by the planning commission because of number of changes needed.  October 6th continuance.  Centennial will continue through the next subdivision.  Centennial may not pass over the drainage route.   

·   The city requires the SID to maintain the $.85 levy because they want citizens of subdivision to pay down a large portion of the debt prior to annexation.

·   Shopko owns land north of Giles in the Mayfair subdivision and don't appear to be interested in building a store on the property at this time.  Since 1/3 of Mayfair consists of the land owned by Shopko, their debt to value ratio around 9%.

·   The group that own’s the La Vista Walmart property is looking for retailer to sub-lease.  

·   Southport is going to be annexed by La Vista this fiscal year (2006). 

There being no other business conducted, the meeting was adjourned at approximately 8:15 pm.
